Terms of Service

By using Notalia ("the App"), you agree to these Terms of Service. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use Notalia. By creating an account or using the App, you confirm that you meet this age requirement.

2. Account

  • You are responsible for maintaining the security of your account credentials.
  • You may create one account per person. Guest access does not require an account but data is limited to a single device and may expire after 30 days of inactivity.
  • We reserve the right to suspend or terminate accounts that violate these terms.

3. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Upload content that infringes on third-party intellectual property rights
  • Attempt to access other users' data or bypass security measures
  • Use automated scripts or bots to interact with the App
  • Deliberately overload or disrupt the service

4. Your Content

  • You retain ownership of all notes, files, and content you connect or upload to Notalia.
  • By using the App, you grant us a limited license to process your content solely for the purpose of generating quizzes and providing the service.
  • We do not claim ownership of your content. We do not sell, share, or use your content for purposes other than operating the App.

5. AI-Generated Content

  • Quizzes are generated using artificial intelligence (Anthropic Claude) based on your notes.
  • Handwritten notes are converted to text using a vision model (Qwen) based on your note submission.
  • AI-generated quiz questions/answers and converted note content may contain errors or inaccuracies. You should verify important information independently.
  • We do not guarantee the accuracy, completeness, or educational value of generated quizzes.

6. Third-Party Services

  • Notalia integrates with GitHub, Google Docs, OneNote, and Notion via OAuth. Your use of these services is governed by their respective terms.
  • We access your content on these platforms only with your explicit authorization and only to provide the quiz generation service.
  • You may disconnect any third-party service at any time from the App settings.

7. Subscriptions and Payments

  • Notalia offers free and paid tiers. Paid subscriptions are processed through Apple App Store or Google Play Store.
  • We do not handle payment information directly. All billing is managed by the respective app store.
  • Payment is charged to your App Store or Google Play account upon confirmation of purchase.
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
  • You can manage or cancel your subscription at any time through your device's App Store or Google Play settings.
  • Refund policies are governed by the platform through which you subscribed.

8. Usage Limits

  • The App enforces per-user limits on quiz generation, document processing, and file uploads based on your subscription tier.
  • Attempting to circumvent usage limits may result in account suspension.

9. Data and Privacy

  • Our collection and use of your data is described in our Privacy Policy.
  • You may delete your account and all associated data at any time from the App settings.
  • Guest user data may be automatically deleted after 30 days of inactivity.

10. Service Availability

  • We strive to keep Notalia available but do not guarantee uninterrupted access.
  • We may modify, suspend, or discontinue features with reasonable notice.
  • We are not liable for any loss of data due to service interruptions.

11. Limitation of Liability

To the maximum extent permitted by law, Notalia and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, academic performance, or business opportunities.

12. Intellectual Property

  • The Notalia app, its design, code, and branding are the property of Notalia.
  • You may not copy, modify, distribute, or reverse-engineer any part of the App.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date. Continued use of the App after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of the applicable jurisdiction.
